Terms of Service

1. Who we are

frutti.ai (the "Service") is operated by Fast AI Labs ("we", "us", "our"). You can reach us at [email protected].

2. Eligibility & accounts

• You must be at least 18 years old and able to form a binding contract.
• You are responsible for your account, your login credentials, and all activity under it. Keep them secure and tell us promptly of any unauthorised use.
• You must provide accurate information and keep it up to date.

3. The Service

frutti.ai helps you generate text, images, and video using artificial intelligence, and helps you draft and schedule content for third-party platforms. Generation consumes credits; billing and refunds are governed by our Refund Policy, which forms part of these Terms. The Service is provided on an "as is" and "as available" basis and may change, and features may be added or removed, over time.

4. AI output — no guarantees

AI output is probabilistic. We do not warrant that output will be accurate, original, non-infringing, fit for a particular purpose, or free of similarity to other outputs. You are solely responsible for reviewing, editing, and deciding whether to publish any output, and for ensuring it complies with the law and with the rules of any platform you post it to.

5. Your content & ownership

• You retain ownership of the prompts and materials you submit ("Input"). As between you and us, you own the output generated for you ("Output"), to the extent it is capable of ownership and subject to the terms of the underlying AI providers.
• You grant us a worldwide, non-exclusive licence to host, process, transmit, and display your Input and Output as needed to operate, secure, and improve the Service.
• You represent that your Input does not infringe anyone's rights and is not unlawful, and that you have the rights needed to grant the licence above.

6. Acceptable use

You must not use the Service to:

• break the law or infringe intellectual-property, privacy, or publicity rights;
• create or distribute spam, malware, deceptive, hateful, harassing, sexually exploitative, or harmful content;
• impersonate others or generate content that violates the terms of X, Reddit, LinkedIn, Instagram, or any platform you connect or post to;
• reverse-engineer, scrape, resell, or build a competing product from the Service, or circumvent rate limits, credit accounting, or security;
• misuse the Service in a way that burdens our infrastructure or our third-party providers.

We may suspend or terminate accounts that breach this section, without refund.

7. Third-party platforms & providers

The Service connects to and relies on third parties (including AI model providers, X/Twitter and other social platforms, payment, authentication, and hosting providers). Your use of those platforms is subject to their terms, and we are not responsible for their acts or omissions, including suspensions, bans, rate limits, data changes, or outages affecting your accounts or content.

8. Billing

Paid plans are billed in advance through our payment processor (Stripe) and renew automatically until cancelled. Taxes may apply. Cancellation, renewals, and refunds are governed by the Refund Policy.

9. Intellectual property

The Service itself — its software, design, branding, and content (other than your Input/Output) — belongs to us or our licensors and is protected by law. These Terms grant you no rights in it other than the limited right to use the Service as permitted.

10. Disclaimers

To the fullest extent permitted by law, the Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Output is not professional, legal, financial, or other advice.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, goodwill, or platform-account actions. Our total aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the three (3) months before the event giving rise to the claim.Nothing in these Terms excludes liability that cannot be excluded by law.

12. Indemnity

You agree to indemnify and hold us harmless from claims, losses, and costs (including reasonable legal fees) arising from your Input or Output, your use of the Service, your published content, or your breach of these Terms or of any third-party platform's rules.

13. Suspension & termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service or other users. On termination your right to use the Service ends; sections that by their nature should survive (e.g. ownership, disclaimers, liability, indemnity, and governing law) will survive. Termination for breach does not entitle you to a refund.

14. Changes

We may update these Terms; material changes will be reflected by the "last updated" date and, where appropriate, by notice. Continuing to use the Service after changes take effect means you accept them.

15. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that mandatory consumer-protection rights in your country of residence are unaffected.
